EU arrest warrant must apply fully in Croatia
On 18 September 2013 the European Commission launched a so-called “Article 39 procedure” against Croatia for having unilaterally provided in national law that the EU European Arrest Warrant – which replaces traditional extradition with a faster streamlined procedure for serious crimes – will apply only to crimes committed after August 7, 2002. Today, in the absence of horizontal legislation on trade disputes, all litigation decisions are on a case by case basis; which is very slow and not an effective deterrent for trading partners who do not fulfil their contractual obligations.
